Terms of Service

1. Agreement to Terms

By accessing or using RepSquad ("the App"), which is operated by escapethematrix.app ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the App.

2. Description of Service

RepSquad is a mobile fitness application that uses on-device AI technology to track and count various exercises. The App provides:

• Real-time exercise counting using AI pose detection (Push-Ups, Squats, Jumping Jacks, Hip Abduction Standing, Lunges, Calf Raises, Biceps Curls, Front Raises, Lateral Raises, Overhead Dumbbell Press, and Pull Ups)
• Workout session tracking and history
• Progress analytics and statistics
• Cloud synchronization of workout data
• Personalized local notifications (workout reminders, progress updates, milestone achievements)
• Subscription-based premium features
• FitStation (Institution Mode): group workout tracking for schools, gyms, and studios - leaderboards, session tracking, and shared stats (requires separate Institution subscription)
• Social features: an opt-in global leaderboard and Rep Battles (head-to-head challenges) with curated emoji reactions ("battle chat")

3. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

By using the App, you represent and warrant that:

• You are of legal age to form a binding contract
• You have the authority to enter into these Terms
• Your use of the App will not violate any applicable law or regulation

4. Account Registration

Sign-in is optional. You can use the App's core workout tracking features without creating an account. However, to use certain features such as cloud sync, cross-device access, notifications, and subscription services, you must register for an account using Sign In with Apple. When you sign in with Apple, your User ID (provided by Apple) serves as your primary account identifier. You may optionally create a username from the Profile screen if you wish, but it is not required. If you choose to create an account, you agree to:

• Provide accurate, current, and complete information during registration
• If you choose to create a username, ensure it complies with our requirements (1-8 characters, alphanumeric and underscores only)
• Maintain and update your account information, including your optional username, to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4.1 Local-Only Mode

You may use the App without signing in. In local-only mode:

• Core workout tracking features are available (rep counting, local metrics, local calendar)
• Your data is stored locally on your device
• Premium features (cloud sync, advanced analytics, unlimited sessions) are not available
• Subscription management options are not shown until you sign in - Settings may show a Sign In for Premium Features entry
• The app may show a Premium explanation screen when you tap locked features or after milestones; you can tap Back to stay in local-only mode (automatic prompts are rate-limited)
• You can sign in at any time to enable premium features and subscription management

5. Use of the App

5.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.

5.2 Prohibited Uses

You agree not to:

• Use the App for any illegal purpose or in violation of any local, state, national, or international law
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers connected to the App
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Remove any copyright, trademark, or other proprietary notices from the App
• Use the App to transmit any viruses, malware, or other harmful code
• Use automated systems (bots, scrapers) to access the App
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

5.3 Social Features and User Content

The App offers optional social features: an opt-in global leaderboard, Rep Battles (head-to-head challenges), and "battle chat" emoji reactions. By using these features you agree to the following:

• Public display: If you opt in to the global leaderboard or join a Rep Battle, your display name (handle), scores, reps, form grade, and rank are visible to other users. Do not set a handle that is offensive, infringing, or impersonates another person.
• No objectionable content; zero tolerance: Battle reactions are limited to a fixed, curated set of emoji - there is no free-text or media messaging. You agree not to use the social features to harass, threaten, bully, or otherwise abuse other users. There is no tolerance for abusive or objectionable behavior.
• Block and report: You can block another user to hide their reactions, and report a user for abuse. We review reports and may remove content, suspend, or permanently ban users who violate these Terms, at our sole discretion and without notice.
• Your responsibility: You are solely responsible for your handle and your use of the social features and any consequences of that use.

6. Subscription Services

6.1 Subscription Plans

The App offers subscription plans and a lifetime purchase option with the following premium features:

• Cloud Sync: Sync your workout data across all your devices securely
• Advanced Analytics: Track your progress with detailed metrics and insights
• Unlimited Sessions: Record as many workout sessions as you want

Subscription plans (USD reference pricing; actual price may vary by region and is shown at purchase in the App Store):

• Weekly Subscription: $1.99 per week (auto-renewable, no free trial)
• Free Trial: 3-day free trial included with Monthly or Annual subscription purchase (StoreKit introductory offer)
• Monthly Subscription: $7.99 per month (includes 3-day free trial)
• Annual Subscription: $59.99 per year (includes 3-day free trial)
• Lifetime Access: $99.99 one-time purchase (non-consumable in-app purchase, no trial, no recurring charges)

Note: Personal subscriptions require Sign in with Apple. Non-signed-in users may see a Premium explanation screen with Sign in with Apple when they tap premium-gated features; they can dismiss it and keep using local-only mode. Subscription management and purchases appear after sign-in. All core workout tracking features are available without sign-in.

Lifetime Access: The Lifetime Access purchase is a one-time, non-refundable payment that grants permanent access to all premium features. It is not a subscription and does not auto-renew.

6.1.1 Institution Mode (FitStation) - Separate Plans

FitStation (Institution Mode) is for schools, gyms, and studios. It uses separate products from the personal subscription plans above. Institution mode is not included in Monthly, Annual, or Lifetime personal subscriptions. To use Institution mode, you must sign in with Apple and purchase an Institution product:

• Institution Monthly: $19.99 per month (includes 7-day free trial, auto-renewable)
• Institution Lifetime: one-time purchase; price varies by region. See in-app paywall for your price. (non-consumable, no trial)

Institution mode enables group workout tracking, leaderboards, session stats, and shared institution cards. The same subscription terms in 6.2 and 6.3 apply to Institution subscriptions where applicable (e.g. Institution Monthly auto-renews; Institution Lifetime does not).

6.2 Subscription Terms

• Subscriptions (Weekly, Monthly, and Annual) are managed through Apple's App Store and are subject to Apple's terms and conditions
• Weekly, Monthly, and Annual subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage your subscription and cancel at any time through your Apple ID account settings
• No refunds will be provided for any unused portion of a subscription period
• We reserve the right to change subscription prices with 30 days' notice
• The Lifetime Access purchase does not auto-renew and does not require cancellation

6.3 Free Trial

The free trial is included with subscription purchase via StoreKit2 introductory offers. If you start a free trial, you will be charged when the trial period ends unless you cancel before the trial expires. You can cancel at any time during the trial period without being charged. The trial period is managed by Apple's StoreKit2 system.

7. Account Deletion

7.1 Account Deletion for Signed-In Users

Regular mode: From Settings → Account → Delete Account, you can permanently delete your account. This will:

• Permanently delete your user profile and all associated workout data
• Delete all workout sessions synced to the cloud, including institution workout sessions and membership data
• Clear all local app data (workout sessions, preferences, etc.)
• Cancel any active subscriptions (subscription records may be retained for legal/accounting compliance)
• Sign you out of the app

FitStation (Institution mode): Delete Account in institution Settings only unclaims institutions and leaves - your personal account and workout data remain in the cloud. You are signed out and returned to the sign-in screen. To request permanent removal of your account and data (GDPR), use "Request Data Deletion" in the success alert to open a pre-filled email to support with your User ID; we will process your request within 30 days.

Account deletion is permanent and cannot be undone. Please ensure you have exported or saved any data you wish to keep before deleting your account.

7.2 Local-Only Mode Users

If you use the app without signing in (local-only mode), no account is created and no data is stored on our servers. Your workout data is stored only on your device. To remove all local data, you can delete the app from your device. If you wish to use the account deletion feature, you must first sign in with Apple.

7.3 Data Retention

After account deletion, we will delete your personal data within 30 days, except where we are required to retain certain information for legal, accounting, or regulatory compliance purposes (such as subscription payment records).

8. Intellectual Property

The App and its original content, features, and functionality are owned by escapethematrix.app and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works based on the App
• Use our trademarks, logos, or brand names without our written permission
• Remove or alter any copyright, trademark, or other proprietary notices

9. User Content

You retain ownership of any workout data and content you create using the App. By using the App, you grant us a license to:

• Store and process your workout data to provide the App's services
• Sync your data across your devices
• Generate analytics and progress reports

You are solely responsible for your content and data. We do not claim ownership of your workout data.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or availability of the App

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• The rep counting will be 100% accurate in all conditions

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ESCAPETHEMATRIX.APP, REPSQUAD, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the App
• Any injuries or health issues resulting from exercise or use of the App

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

12. Health and Safety Disclaimer

• The App is not a medical device and should not be used for medical diagnosis or treatment
• Exercise may not be suitable for everyone
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• Use the App in a safe environment with adequate space
• Ensure proper form and technique to prevent injury
• We are not responsible for any injuries that may occur while using the App

13. Indemnification

You agree to indemnify, defend, and hold harmless escapethematrix.app, RepSquad, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any injuries or damages resulting from your use of the App

14. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Request by law enforcement or government agencies
• Extended periods of inactivity

Upon termination, your right to use the App will cease immediately. You may terminate your account at any time by signing out and deleting the App.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is operated, without regard to its conflict of law provisions.

For users in the European Union, these Terms are governed by the laws of your country of residence.

17. Dispute Resolution

If you have any dispute with us, you agree to first contact us to seek a resolution. If we cannot resolve the dispute within 60 days, you agree to resolve disputes through binding arbitration or small claims court, as applicable in your jurisdiction.

18. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable)
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and escapethematrix.app regarding the use of the App and supersede all prior agreements and understandings.
