Terms of Service

1. Agreement to Terms

By accessing or using Body Vitals: Health Widgets ("the App"), which is operated by escapethematrix.app ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the App.

2. Description of Service

Body Vitals: Health Widgets is a mobile application for iOS that provides:

• A health dashboard displaying 20+ metrics from Apple HealthKit
• Widget-first experience across home screen and lock screen, with StandBy support in Pro
• A daily readiness score computed from multiple physiological signals
• Anomaly detection for significant health deviations
• Template-based coaching notes (Free tier)
• On-device AI coaching powered by Apple Foundation Models (Pro tier)
• Composite health scores: Longevity, Cardiovascular, Metabolic, Circadian, Mobility (Pro tier)
• Readiness Radar, Recovery Forecast, and Weekly Pattern visualizations (Pro tier)
• 6 HUD themes for dashboard customization (1 free, 5 Pro)

Body Vitals is designed around on-device health processing and no account requirement for core features.

3. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

By using the App, you represent and warrant that:

• You are of legal age to form a binding contract
• You have the authority to enter into these Terms
• Your use of the App will not violate any applicable law or regulation

4. No Account Required

Body Vitals does not require account creation or sign-in. There is no registration process. You can use the full functionality of the App (within your tier) immediately after granting HealthKit permissions.

5. Use of the App

5.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.

5.2 HealthKit Data Access

The App requires access to Apple HealthKit to function. You control which categories Body Vitals can access through iOS permission prompts. You may revoke permissions at any time through iOS Settings > Health > Data Access & Devices. Body Vitals reads HealthKit data and may write workout/activity records where described in app permission strings.

5.3 Prohibited Uses

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Copy, modify, or create derivative works of the App
• Remove any copyright, trademark, or proprietary notices from the App
• Use the App to transmit viruses, malware, or other harmful code
• Use automated systems to access the App

6. In-App Purchase

6.1 Pro Tier

The App offers a one-time Pro upgrade through Apple's In-App Purchase system:

• Pro - one-time purchase (launch framing: $19.99): Unlocks large widgets, StandBy Readiness Dial, Recovery Forecast, Readiness Radar, Weekly Pattern, weekly health heatmap, full AI coaching, and 5 additional themes

The Pro purchase is non-consumable - you buy it once and it persists across device restores and new devices linked to the same Apple ID.

6.2 No Subscription

Body Vitals does not offer subscriptions. Pro is a one-time purchase with no recurring charge.

6.3 Purchase Terms

• All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions
• Refund requests must be directed to Apple through the App Store
• We reserve the right to change the Pro price for new purchasers with reasonable notice; existing purchases are not affected

7. Data and Deletion

Since Body Vitals stores all data locally on your device and does not collect or store any data on servers:

• To delete all app data, simply delete the app from your device
• To manage your health data, use the Apple Health app
• There is no account to delete, no cloud data to request removal of, and no server-side records

8. Intellectual Property

The App and its original content, features, and functionality are owned by escapethematrix.app and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works based on the App
• Use our trademarks, logos, or brand names without written permission
• Remove or alter any copyright, trademark, or proprietary notices

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of health data or scores

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The readiness score, composite scores, or AI coaching will be accurate for your situation
• Defects will be corrected
• The App is free of harmful components

10. Health and Safety Disclaimer

• The App is not a medical device and has not been evaluated by the FDA or any regulatory body
• Health scores and readiness values are approximations based on available data and published research weights - they are not clinical measurements
• AI coaching is generated by on-device language models and may contain inaccuracies
• Anomaly detection is best-effort and may produce false positives or miss real anomalies
• The accuracy of displayed data depends on the accuracy of underlying HealthKit sources (Apple Watch, third-party devices, manual entries)
• We are not responsible for any health decisions or outcomes based on information displayed by the App

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ESCAPETHEMATRIX.APP, BODY VITALS, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the App
• Any health decisions, injuries, or medical outcomes resulting from use of the App

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App, or $50, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless escapethematrix.app, Body Vitals, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any health decisions made based on information displayed by the App

13. Termination

Since Body Vitals has no account system, there is no account to terminate. You may stop using the App at any time by deleting it from your device. We reserve the right to remove the App from the App Store at any time.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will update the "Last Updated" date on this page. By continuing to use the App after revisions become effective, you agree to the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App is operated, without regard to conflict of law provisions.

For users in the European Union, these Terms are governed by the laws of your country of residence.

16. Dispute Resolution

If you have any dispute with us, you agree to first contact us to seek a resolution. If we cannot resolve the dispute within 60 days, you agree to resolve disputes through binding arbitration or small claims court, as applicable in your jurisdiction.

17. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and escapethematrix.app, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide support for the App
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable)
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and escapethematrix.app regarding the use of the App and supersede all prior agreements and understandings.
