Terms of Service

These Terms of Service ("Terms") govern your use of Presence: Appearance & Aura AI ("Presence," "the App") developed and operated by escapethematrix.app ("we," "us," "our"). By downloading or using Presence, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 12 years of age to use Presence. By using the App, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Presence for your personal, non-commercial use on Apple-branded devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse-engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our written permission
• Use the App to develop a competing product or service

3. Subscriptions and Purchases

3.1 Available Plans

Presence offers in-app purchases including auto-renewing subscriptions (Weekly at $6.99/week and Annual at $49.99/year) and a one-time Lifetime purchase ($99.99). You may complete a single Fit Check during onboarding before subscribing; ongoing use of all 19 features requires an active subscription or Lifetime purchase except where the app explicitly shows a score or summary without a purchase (for example the composite Presence Score on the dashboard).

3.2 Billing

All purchases are processed by Apple through the App Store. Your Apple ID account will be charged at the time of purchase confirmation. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

3.3 Cancellation

To cancel a subscription: Settings → [Your Name] → Subscriptions → Presence → Cancel Subscription. Cancellation takes effect at the end of the current paid period - you retain access until then. We cannot process refunds directly; submit refund requests via Apple's report a problem page.

3.4 Price Changes

We reserve the right to change subscription prices. We will provide advance notice of any price changes. Continued use of the App after a price change constitutes your acceptance of the new price.

3.5 Plan and feature changes

We reserve the right to modify which features are available without a purchase, which require a subscription or Lifetime purchase, and subscription prices or plan structure at any time, with reasonable advance notice to existing subscribers.

4. App Functionality and Accuracy

Specifically:

• Facial Age is a visual estimate and not a dermatological diagnosis.
• Posture Age is an estimate based on photo analysis and not a physiotherapy or medical assessment.
• Grooming Score, FitCheck, Smile Wealth Index and all other scores are appearance-based estimates for personal improvement tracking, not professional opinions.
• Aura Score is based on self-reported and HealthKit data - it is not a psychological or medical metric.

Do not use Presence scores as the basis for medical, dermatological, psychological, or any health-related decisions. Consult a qualified professional for any health concerns.

5. HealthKit Integration

Presence may request access to Apple Health data. By granting this access, you authorize the App to read (not write) health data to enhance feature insights. This access is optional and can be revoked in iOS Settings at any time. We do not store, transmit, or share HealthKit data.

6. Camera and Photos

By using camera or photo features within Presence, you represent that you have the right to photograph or analyze the subjects in those images. Do not use the App to analyze individuals without their knowledge and consent.

7. Intellectual Property

Presence and all its contents, features, and functionality - including but not limited to text, graphics, logos, icons, the Presence Score methodology, InsightEngine algorithms, and all software - are owned by escapethematrix.app and protected by applicable intellectual property laws.

8. Disclaimer of Warranties

Presence is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that analysis results will be accurate for any specific purpose.

9. Limitation of Liability

To the maximum extent permitted by applicable law, escapethematrix.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the App.

Our total liability to you for any claims arising from these Terms or use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in India.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or by updating the "Last updated" date above. Continued use of the App after changes constitutes your acceptance of the updated Terms.

12. Termination

We reserve the right to terminate or suspend your access to Presence at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Sections 7, 8, 9, and 10 survive termination.
